just sold for $19500 two months ago. I however
dont share that setiment - the 2.1s are anemic

And because you can yank the driveline and stick in a om617/42rh and have legal swapped jeep.

It's pretty easy to get the fuel type changed from gas to diesel in DE....no reason to pay a premium for it. Went through it on the -10 as it's titled & tagged as one of its (many) parts vehicles, an '84 CJ7. Title now reads 1984 Jeep CJ7 diesel pickup w/ a 8k gvw.

De doesnt care what year the motor came out of. As long as the vehical is pre diesel emission year. Pre '07 i think. You can file for a change of fuel and then there is no emision check.
Im pretty sure u can do after 07 as long as the ecm reads no emmision faults.
Btw , for a gas motor it just has to meet the emision standard for the year of the vehical. You can put a carbed '86 chevy 350 in a 93 yj as long as it sniffs clean.

There was no question on the -10 other than "is it a diesel?" They spent more time concerned with the weight rating based on the .mil data plate and the fact that the type HAD to be changed to 'pkup' than the drivetrain in it.
Frankly unless it's >'96 and can be scanned vs sniffed they really don't care...and even then if it scans clean you're fine. Unlike commiefornia and a few other states there is little scrutiny as to what motor is in the vehicle, just that it either scans clean w/ all readiness codes set or that it sniffs clean as per the standards for the yr/make/model.

... legally speaking youre both right...
Engine swapping falls under the control of the EPA, not
local law enforcement. And they are VERY clear about the
statutes...The way the Mobile Source Enforcement Memo reads is
pretty cut-and-dry. Basically it says an OWNER may be
allowed to replace/swap an engine so long as he makes
a good faith effort to retain (or improve) the emissions
standards of the vehicle for that particular model year.
The way i read this though is that if your 1980 civic motor
has better emissions than your 96 4.0L there is no legal
reason preventing you from doing the swap, however
unlikely that senerio is... A 1987 4.0L being put into a 1996
Xj would probably fly as well seeing a "reasonable" owner
could infer they are basically the same motor and therefore
have equivilent smog readings.If one were caught blatantly ignoring emissions standards
(say by putting a 1966 427cid into a Yj and then driving it
on the street) first offense is $2,500, a year in jail, and
forfeit of said vehicle for destruction. Oh and keep in mind
that is a federal offense...Now heres the catch - the EPA is *currently* not actively
pursuing individuals on the condition of their car so the
chances of being caught are pretty much nil. However, if
you get stopped by the wrong cop, or inspected by the
wrong DMV tech, then it will get very real, very quick... -
so get a 1966 427 and throw in a couple high flow cat converters
